Engineer’s Lawsuit Dismissed in Dispute with Leonardo on Workplace Accommodations for Transgender Co-Worker

An employment tribunal has dismissed all discrimination claims by an engineer against the defence company Leonardo UK. Maria Kelly, who raised concerns about sharing women’s toilets with transgender colleagues, accused the company of harassment and sex discrimination. Her case was heard in Edinburgh, but the tribunal ruled against her.

Judge Michelle Sutherland stated that out of Leonardo’s 9,500 employees, only Kelly raised an objection to the firm’s toilet access policy. The judge found this policy reasonable, suggesting women use single-occupancy toilets if privacy is a concern. She concluded that the policy posed no disadvantage to employees and didn’t increase the risk of assault.

Maria Kelly, who chose to use a “secret” toilet after an encounter with a transgender colleague, expressed her disappointment, claiming the ruling misinterpreted both the law and her position. She plans to appeal, believing it contradicts an earlier Supreme Court ruling on sex and gender definitions.
