A man claiming unfair dismissal has won over £16,000 after being sacked for saying “top of the morning to ya” in a mock Irish accent. Karl Davies, 57, who worked at Wrexham’s Oscar Mayer for 27 years without any previous disciplinary issues, faced the axe for the quirky greeting. The incident occurred while listening to Irish music and saying the phrase in front of a “red-headed” external auditor.

Tribunal Judge Vincent Ryan acknowledged that Davies was notably “channeling the musical vibe” but did so in a “reprehensible” manner, repeatedly teasing his manager, Scott Millward, who found it grating and embarrassing. Despite Oscar Mayer categorising it as harassment, the judge found no evidence of racial intent or effect, noting that Mr. Davies didn’t even know if the auditor was Irish.

The tribunal highlighted flaws in the investigation process, including a manager with a prior unresolved grievance against Davies leading the inquiry. Witness accounts were inconsistent, and assumptions were rife. Despite the employer viewing the remark as a possible racial slur that could create a hostile work environment, the tribunal ruled the dismissal unfair, noting a lack of consideration for Davies’s exemplary record and service tenure.

Reflecting on the decision, the judge clarified that the ruling was not a stance on current debates around “wokeness,” but rather about procedural fairness and evidence. What’s your take on this surprising twist?
